Welcome and thank you for your interest in Dark Agent ("Dark Agent", "we", or "our"), as well as our website, our software, hosted or downloadable applications, and other related services (collectively, the "Service"). These Terms of Use, together with our Privacy Policy, constitute a legal contract between you and Dark Agent for the use of the Service.

If you are using the Service on behalf of a company or organization that has a current subscription contract with Dark Agent, that contract will prevail in the event of a conflict with these Terms.

About the Service

The Dark Agent platform offers a set of artificial intelligence-based programming tools to facilitate and optimize code development, as well as suggest code snippets, results, or other features.

1. Requirements for Use

To use the Service, you must be at least 18 years old or the legal age in your jurisdiction, whichever is higher. By accepting these Terms, you represent that: (a) you meet the minimum age requirement; (b) you have never been banned from the Service; and (c) you are in compliance with all applicable laws and regulations. If you are acting on behalf of a company, you represent that you have authority to bind it to these Terms.

2. Account and Registration

Some features require creating an account. You must provide accurate, up-to-date, and complete information. The responsibility for protecting your login and password is entirely yours. If you suspect unauthorized access, contact us via email at our support.

3. Payment Terms

Some Service features may be paid. Before charging, you can review the applicable prices. Unless otherwise indicated, all prices are charged in US dollars and are non-refundable, except as required by law.

3.1. Pricing

Dark Agent may change prices at any time with prior notice. Your continued use of the Service after the change means acceptance of the new prices. Related taxes are your responsibility.

3.2. Payment Processing

Payments are processed by third parties, such as Stripe, Inc. ("Stripe"). The use of these solutions is subject to the terms and policies available at Stripe's website. Dark Agent is not responsible for payments made through such processors.

3.3. Subscriptions

The Service may offer subscription plans with automatic renewal. Billing will occur periodically according to the chosen plan, until you cancel the subscription through the billing menu or contact us via the support email.

3.4. Delinquent Accounts

In case of payment delay, Dark Agent may suspend or cancel your access to the Service. Penalties and collection fees may apply.

4. Licensing

4.1. Limited License

You receive a limited, non-exclusive, and revocable license to use the Service according to the conditions of these Terms.

4.2. Use Restrictions

It is prohibited to: (a) copy, distribute, or create derivatives of the Service; (b) modify the Service; (c) perform reverse engineering; (d) send sensitive data that require special protection by law; (e) store or transmit viruses or malicious code; (f) use automated devices to extract data from the Service; among other prohibited uses.

4.3. Suggestions

If you send improvement suggestions ("Feedback"), Dark Agent will have the right to use them freely for any purpose, without attribution obligation.

5. Artificial Intelligence Generated Content

5.1. Ownership

You own the content generated by AI from your instructions, respecting Dark Agent's ownership of the underlying technology and models.

5.2. License to Your Data

By submitting data to the Service, you grant permission for internal use, improvement, and development of our AI models, respecting the confidentiality of your proprietary code.

5.3. Responsibility

You are responsible for reviewing and validating any AI-generated content before using it. Dark Agent does not guarantee the accuracy or suitability of such content.

6. Privacy and Data

6.1. Data Collection

We collect information about your account, Service usage, submitted content, technical information, and other data as described in our Privacy Policy.

6.2. Data Security

We adopt reasonable measures to protect your data, but no system is completely secure. You are responsible for protecting your credentials.

10. Limitation of Liability

Under no circumstances will Dark Agent be liable for indirect, incidental, special, or consequential damages resulting from the use of the Service.
